Decisions of the European Court

Decisions of the European Court – the Court interprets the provisions of incorporation charters and resolves disputes in the claims filed by member states as well as citizens whose rights have been violated by a decision of any EU body. It was established in 1952 with its HQ in Luxembourg. Decisions adopted by the European Court are binding upon all hierarchically subordinate courts i.e. upon all national courts of member states. The interpretation of any issue by the European Court is binding upon all future decisions of hierarchically subordinate courts.

Decisions of the European Commission

Decisions of the European Commission – the primary task of the European Commission is to prepare and propose regulations while representing the interests of EU citizens, autonomously from member states. The Commission has a sole right to prepare proposal drafts, which are sent to responsible bodies (the EU Council and the European Parliament) to be decided upon. It passes numerous implementation regulations facilitating the execution of the EU Council regulations (guidelines, ordinances, decisions). It has an important supervisory authority seen in its right to bring charges against member states before the European Court of Justice for the violation of incorporation charter provisions.

Decision of the State Commission for Supervision of Public Procurement Procedure

State Commission for Supervision of Public Procurement Procedure is an autonomous and independent entity responsible for resolving public procurement claims. All decisions resulting from appeals before the State Commission are publicly announced on their web page.

Opinions of the Public Procurement Administration Office

Opinions of the Public Procurement Administration Office – a central state administration body responsible for the development of the public procurement system, public procurement enhancement and coordination, bills and other public procurement regulation development, interpretation, supervision and execution as well as for filing infromation in infringement procedures. Opinions of the Public Procurement Administration Office are not binding.

Green Public Procurement

The Ministry of Environmental and Nature Protection and the Green Public Procurement Committee have jointly developed the National Action Plan for Green Public Procurement for the period between 2015 – 2017 with the projection until 2020, which was adopted by the Government of the Republic of Croatia in August 2015.
 
The purpose of said National Action Plan is to utilize the public procurement system in the Republic of Croatia for stimulating the procurement of products and services which have a smaller ecological footprint compared to equivalent products and services i.e. to define the activities which will result in the above. In this manner, all entities can contribute to reducing their ecological footprint caused by their business operations.
 
With that in mind, priority groups of products and services which can, in the shortest period possible, facilitate the achievement of the strategic objective of the 50% of conducted public procurement procedures in Croatia under the implementation of green instruments until 2020, have been defined.
 
For the first three-year period (2015-2017), these are the following:
  1. copy and printer paper
  2. motor vehicles
  3. office and IT equipment
  4. electricity
  5. telecommunication services and mobile phone services with devices
 
For the second three-year period (2017-2020), three more categories are added as follows:
  1. furniture
  2. food products
  3. building design and construction.
